By downloading, installing, accessing, or using the Kalaidoscope iOS application and/or our website (collectively, the "Services"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Services.
2. Eligibility
You must be at least 16 years old (or the age of digital consent in your country) to use the Services, or have verifiable consent from a parent/guardian.
3. Description of the Services
Kalaidoscope analyzes colors on your device. All analysis is performed on-device; images are not uploaded to our servers. The website may provide information and a contact form for support.

4. Accounts
No user account is required at this time.
5. Purchases, Pricing & Refunds
- Payments are processed exclusively by Apple (App Store) as the merchant of record.
- Pricing, taxes, and refunds are governed by Apple's App Store terms and policies.
- We do not receive or store your payment card details.
6. License & Intellectual Property
We grant you a limited, non-exclusive, non-transferable, revocable license to use the app on Apple-authorized devices you own or control, in accordance with these Terms and Apple's usage rules. All rights in the Services remain with us and our licensors.
7. Acceptable Use
- No unlawful use or infringement of third-party rights.
- No attempts to gain unauthorized access, disrupt, or interfere with the Services.
- No transmission of malware or malicious code.
8. User Content
Contact form submissions are your responsibility; do not submit confidential, sensitive, or illegal content. You grant us a non-exclusive right to use the submission solely to respond and provide support.
9. Privacy
The app does not collect personal data or upload images. If you use the website contact form, we process your email, name, and message solely to respond. See our Privacy Policy.
10. Third-Party Services
No third-party analytics or ad SDKs are used in the app. Payments are handled by Apple.
11. Device Permissions
The app may request access to the camera and photos to analyze colors. Manage permissions in iOS settings.
12. Availability & Updates
We may modify, suspend, or discontinue parts of the Services and may deliver updates to improve performance, security, or features.
13. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, express or implied.
14. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect or consequential damages. Our total liability shall not exceed the amount paid for the app, if any.
15. Indemnification
You agree to indemnify and hold us harmless from claims arising from your misuse of the Services or breach of these Terms.
16. Termination
We may suspend or terminate your access if we reasonably believe you have violated these Terms or applicable law.
17. Changes to the Terms
We may update these Terms; material changes will be posted. Continued use constitutes acceptance.
18. Governing Law & Venue
These Terms are governed by Swiss law. Exclusive jurisdiction lies with the courts of Zürich, Switzerland.
